Hangzhou City Xiaoshan District “Golden Phoenix Tree” Talent Settlement Program Implementation Method (Trial)

This method is hereby formulated for the purpose of promoting the construction of strengthening the district by talents at a high level, attracting extensive talents to start business and have innovation in Xiaoshan with more active, more open and more efficient talent policies and in compliance with the spirit of Some Opinions on Further Implementing Strategy of Strengthening The District by Talents and Accelerating Xiaoshan Innovative Development of The CPC Xiaoshan Committee Xiaoshan District People’s Government.

 

I. The program target

The implementation of the “Golden Phoenix Tree” talent settlement program is aimed at bringing social resources together through digital measures, precisely solving the life settlement problems through multiple channels for those talents who come to Xiaoshan for starting business and innovation, so as to provide worry-free, excellent and convenient livable environment for starting business and innovation of most talents by means of monetary subsidies and ready house leasing, trying to introduce 100,000 graduates from famous domestic universities, introduce and train 50,000 domestic intermediate and senior talents and introduce 10,000 foreign (overseas) senior talents within five years.

 

II. The subsidy objects and standard  

(I) Domestic intermediate and senior talents

1. Conditions of the objects: those who come to Xiaoshan for business after January 1st, 2018, or sign full-time formal employment labor contract of over five years (five years included) with employers in our district (referred to those enterprises that pay tax to our district finance), have paid endowment insurance at the employer for over 6 months and the duty-paid proof of income including salary and bonus in our district is over 3 months; those business pioneers must provide the business license issued by our district and the duty-paid proof of over half year (a half year included).

To be specific,there are 6 types of the objects: the tip talents (Type A), the state leading talents (Type B), the provincial leading talents (Type C), the city leading talents (Type D), the senior talents (Type E) and the intermediate talents (Type F). The identification of Type A to F talents shall be implemented by referring to the document Hangzhou City Xiaoshan District Talent Classification & Identification Method (Trial).  

2. The subsidy standard:

For Type A talents aged under 75 years old, the method of handling special cases by special manners and case to case shall be implemented;

For Type B talents aged under 65 years old, the house purchase subsidy is one million Yuan, the house renting subsidy is 4,000 Yuan/month and the living allowance is 5,000 Yuan/month;

For Type C talents aged under 60 years old, the house purchase subsidy is 800,000 Yuan, the house renting subsidy is 3,200 Yuan/month and the living allowance is 4,000 Yuan/month;

For Type D talents aged under 60 years old, the house purchase subsidy is 600,000 Yuan, the house renting subsidy is 3,000 Yuan/month and the living allowance is 3,000 Yuan/month;

For Type E talents aged under 60 years old, the house purchase subsidy is 200,000 Yuan, the house renting subsidy is 1,500 Yuan/month and the living allowance is 1,500 Yuan/month;

For Type F talents aged under 35 years old, the house renting subsidy is 1,000 Yuan/month and the living allowance is 300 Yuan/month;

3. The subsidy purpose: the house purchase subsidy shall be released in five years and used for buying the first house in Xiaoshan District, and the higher one will be released in case both of the couple meet the conditions mentioned above; the subsidy for house renting shall be last for three years at the maximum and shall be used for the house renting subsidy in Hangzhou area for those talents who have no house. The house purchase subsidy and the house renting subsidy can not be enjoyed concurrently, it’s allowed to rent before purchase, however the existing policy enjoyment shall be deducted; the living allowance can be enjoyed for three years at the maximum and can be enjoyed concurrently with the house purchase subsidy or the house renting subsidy.  

4. The precondition: the acquisition of the house purchase subsidy or the house renting subsidy must be the case that the applicant himself, his spouse and minor children have no housing in Xiaoshan District and do not enjoy relevant housing favorable policies from March 26th, 2014 to the application day.

The relevant housing favorable policies refer to the applicant himself, his spouse and minor children have enjoyed house purchase (building) under policy favors including the cooperative house building by collecting fund, housing-reform houses, economically affordable housing and house building by land approval etc.

After executing the policies, the talents as mentioned above produced from enterprise training in the district shall enjoy the same treatment of those introduced talents; the house purchase subsidy or house renting subsidy for the newly introduced Type A to F talents in the government sponsored units of our district can be executed by referring to the content herein.

 

 (II) The current year’s graduates from colleges and universities 

1. Conditions of the objects: those current year’s graduates from colleges and universities who sign full-time formal employment labor contract with employers of our district (referred to the enterprises that pay tax to our district finance)for over five years (five years included) and meet one of the following conditions: (1) domestic full-time current year’s master and doctor candidates (have the academic background, degree and double certificates); (2) the full-time current year’s graduates from colleges and universities that have been listed into the former “985”, “211” projects, within the international QS 100 famous colleges and universities and have signed talent agreement with our district; (3) the returned overseas students who have been certified by the state Ministry of Education Overseas Study Service Center with the education background as the current year’s foreign (overseas) master candidates and above.

2.The subsidy standard:

(1) For doctoral candidates, the living allowance in 40,000 Yuan and the bank loan with discounted interest in 300,000 Yuan at the maximum in three years will be offered, including the allowance in 30,000 Yuan will be offered one off after paying social insurance for one month and the balance 10,000 Yuan will be offered one off after the fulfillment of working for three years.

(2) For master candidates, the living allowance in 30,000 Yuan and the bank loan with discounted interest in 200,000 Yuan at the maximum in three years will be offered, including the allowance in 20,000 Yuan will be offered one off after paying social insurance for one month and the balance 10,000 Yuan will be offered once after the fulfillment of working for three years.

(3) For graduates, the living allowance in 20,000 Yuan and the bank loan with discounted interest in 100,000 Yuan at the maximum in three years will be offered, including the allowance in 10,000 Yuan will be offered one off after paying social insurance for one month and the balance 10,000 Yuan will be offered once after the fulfillment of working for three years.

1. The living allowance for the doctors and postgraduates mentioned above shall be subject to the higher and be enjoyed without repetition with Hangzhou City Implementation Method of Living Allowances for Newly Introduced Current Year’s Highly Educated Graduates. The standard of loans with discounted interest as mentioned above shall be implemented subject to the actual interest rate as set in the loan agreement signed by and between the applicant and the bank, and the top interest rate shall not exceed 1.3 times of the same period loan benchmark interest rate of the People’s Bank of China.

2. The living allowance for current year’s graduates from colleges and universities that meet conditions shall not be enjoyed repeatedly with the house purchase subsidy, house renting subsidy and living allowance for other types of talents, and the compensation shall be made after deducting the subsidy enjoyed from policies for those who are identified as higher talent types.

3.The full-time doctoral and master candidates graduated after January 1st, 2018 upon self training in the district shall enjoy the same treatment as that for those introduced talents.  

4.The above mentioned living allowance, loan of discounted interest application time limit is within one year from the graduation day of the applicant, which shall be calculated from the time as indicated in the academic certificate, for returned overseas students it shall be calculated from the graduation time as indicated in the academic certificate and degree certificate identified by Ministry of Education Overseas Study Service Center and no application shall be handled upon exceeding the said time limit.

 

(III)College students during practice period

1. Conditions of the objects: the full-time college students who have practice in enterprises of our district, are from the colleges and universities that have been listed into the former “985” project and have signed talent agreement with our district.

2. The subsidy standard: the living allowance in 500 Yuan/month each shall be offered during the practice period and longest subsidy shall be 6 months.

Those college students who have practice in the practice base enterprises of our district shall not be subsidized repeatedly.

 

(IV) Foreign (overseas) senior talents

1. Conditions of the objects: those senior talents who have foreign nationality or are from Hong Kong, Macao and Taiwan.

2. The subsidy standard:

(1)For the world tip foreign experts introduced by our district, the subsidy shall be offered by means of case to case;

(2)For the national, provincial and city “thousand foreign experts program” experts introduced or self trained by our district, and who have worked over 6 months in our district, the living allowance in 5,000 Yuan, 4,000 Yuan, 3,000 Yuan per month shall be offered and the longest enjoyment shall be three years;

(3)For the talents who have been selected into “Hangzhou City introduced top-end foreign experts”, the living allowance in 3,000 Yuan per month shall be offered, the allowance can be enjoyed for one year by selecting once and the longest enjoyment shall be three years;

(4)For those experts who have been selected into Hangzhou City “115” key, excellent programs and into the subsidy of introducing foreign intelligence by our district, the living allowance in 1,500 Yuan per month shall be offered, the allowance can be enjoyed for one year by selecting once and the longest enjoyment shall be three years;

(5)For foreign talents who have master’s degree and above, and who have worked over 6 months in our district, the living allowance in 800 Yuan per month shall be offered and the longest enjoyment shall be three years.

III. Fund management and setting restriction

1.For the expenditures necessary for the house purchase subsidy for relevant talents in those enterprises and government-sponsored units that are not fully subsidized by government finance, 70% shall be borne by the district finance, and 30% shall be borne by employers. All other expenditures shall be borne by the district finance.

2.The talents introduced from outside by the district are required to have the conditions that the corresponding talent level should have; the self trained talents of our district refer to the talents that have the corresponding talent level after working one year in our district, the involved time node (January 1st, 2018) refers to the time when the honor or academic certificate ortitle that is acquired as the talent identification basis.

3.When talents enjoy subsidy (allowance) and acquire higher level talent identification, according to the subsidy standard as set in this method, the compensation shall be made according to the principle of being subject to the higher but without repetition and shall be upgraded to the corresponding standard. When the same talent meet multiple talent types of support, he shall be subsidized according to the principle of being subject to the higher but without repetition. The various allowances (subsidies) must be released to the applicant himself.

4.Those people who have applied for subsidy before 2018 according to the document spirit as set in Xiaoshan District Implementation Method of Living Allowance and Subsidy for Enterprises to Introduce and Train Senior Talents (Trial) and Xiaoshan District Implementation Method of Talent Settlement Project (Trial) shall still enjoy living allowance or house purchase subsidy, house renting subsidy in the principle of “old method for past persons” , and no compensation shall be made any more.

5.The one-off settlement subsidy policy enjoyed by those senior title professionals introduced by our district in the past and the outbound post doctors in Xiaoshan shall be subject to the higher but without repetition with this document.

6.In case any object that accepts subsidy changes his employer within the district during the period of accepting subsidy, he should handle the subsidy change procedures to the district human resource and social assurance bureau or the urban and rural integration office with the certificate of discharging personnel (labor) relationship and the labor contract signed with the new employer, the payroll and the list of paying endowment insurance (over three months) of the new employer, the copy of business license duplicate of the new employer and the subsidy application table.

7.When the time limit of enjoying senior talent allowance (subsidy) is fulfilled, or the application object has reached the set age, the subsidy shall be terminated naturally; in case the subsidy should be terminated causing from discharging labor contract with the employer, or being treated for criminal illegal behaviors or others, the employer should notify in written (affixed with stamp) to the district human resource and social assurance bureau within the current month in time and stop releasing any allowance (subsidy).

 

IV. Administration of house purchase subsidy

1.Any talent who holds Hangzhou City Xiaoshan District Talent Qualification Certificate for House Purchase Subsidy buys house can not apply and claim the house purchase subsidy before acquiring the house ownership. After acquiring Hangzhou City Xiaoshan District Talent Qualification Certificate for House Purchase Subsidy, the applicant should purchase house within two years, the case of exceeding the said time limit it shall be deemed as automatic waiver and he must re-apply.  

2.Any talent who holds Hangzhou City Xiaoshan District Talent Qualification Certificate for House Purchase Subsidy shall go with his employer to the urban and rural integration office with his house ownership certificate and sign Hangzhou City Xiaoshan District Agreement on Talent House Purchase Subsidy Release(the said agreement shall define the specif information of the purchased house, subsidy release manner and responsible unit, the ownership alteration registration of the purchased house and restrictions on the house transaction in the market, personal initiative declaration, the assistance management duty of the employer etc.).

3.The house purchased by a talent who enjoys house purchase subsidy according to rules shall be co-owned by the talent and government and the ownership is registered under his name. Before the said talent applies and claims for house purchase subsidy, he should hold Hangzhou City Xiaoshan District Agreement on Talent House Purchase Subsidy Release to alter the house ownership certificate to the house ownership registration department, which shall indicate the amount of house purchase subsidy enjoyed by the talent from the government in remarks of the said house ownership certificate. Before canceling the certificate content mentioned above and altering the house ownership certificate, the talent who has enjoyed house purchase subsidy can not dispose the said house by means of buying and selling, gift or pledge (excluding the mortgage of house purchase).

4.The applicant shall hold Hangzhou City Xiaoshan District Agreement on Talent House Purchase Subsidy Release and the altered house ownership certificate to the district housing assurance department for claiming the house purchase subsidy. In case the total price of the purchased house is lower than the enjoyable house purchase subsidy standard, the house purchase subsidy shall be released subject to the total purchased house amount. The house purchase subsidy shall be released on a yearly basis. The subsidy release amount of the first year shall be 40% of the total government finance subsidy amount, in the following 2nd year to the 5th year the subsidy shall be released on schedule each year, and the amount is 15% of the total government finance subsidy amount.

5.The talents who have enjoyed house purchase subsidy must fulfill working for 10 years cumulatively in the employers of our district.

Upon fulfilling the said years, the talent may make an application, his employer shall present Certificate of Talent Service Term Fulfillment, and after the declaration and review according to the talent house purchase subsidy application review procedures, finally the district human resource and social assurance bureau shall present opinions after review, and the said talent may apply to alter the ownership certificate of the purchased house as his personal house property to the house ownership registration department with the identified Certificate of Talent Service Term Fulfillment.

Any talent who terminates working in the employer of our district before reaching the said limit of years shall return the house purchase subsidy according to the ratio of service years within 6 months from leaving our district, the refundable amount = the released house purchase amount - (the total house purchase amount/120 months x the actual service months).

The district urban and rural integration office shall report the returned fund status to the district human resource and social assurance bureau which shall then present the certificate that the house purchase subsidy has been taken back, with which the said talent may then apply to the house ownership registration department to alter the house ownership certificate of the purchased house as his personal house property. In case he rejects to return the said subsidy, legal liability shall be investigated accordingly.

6.In case the house ownership must be transferred as a result of inheritance, legacy, property partition from divorce and the court decision, sentence and meditation etc. to the house purchased by the talent by claiming house purchase subsidy, the house purchase subsidy shall be returned according to Certificate of Talent Service Term Fulfillment identified by the district human resource and social assurance bureau and be acquired according to rules or according the ratio of service years, and he shall not handle the said house ownership transfer procedure before he applies to the house ownership registration department and alters the house ownership certificate.

 

V. Talent renting house

In order to accelerate promoting the talent rental housing construction, according to the mode “leading by government, participation by market”, the district encourages social capital to participate the construction and management of talent rental housing, so as to enhance talent rental housing supply quantity, cultivate a batch of service providers of socialized talent rental housing, execute marketing operation, form the talent rental housing system of supply by multiple main bodies and assurance by multiple channels, and the district will try to provide 10,000 talent rental houses cumulatively by 2020(the specific methods of talent rental housing construction and management shall be formulated separately).

 

VI. Organization administration

1.The district CPC talent work leadership team shall take the lead to organize executing this method. The district CPC talent office shall work together with principals of the district human resource and social assurance bureau, the district urban and rural integration office and the district finance bureau etc. to form a special work team to coordinate and settle problems arising from execution process, and the related functional departments shall perform their own function and enhance coordination.

2.The employers shall be responsible for the truth of the declaration materials of the talents who apply for allowance (subsidy). All towns, sub-districts or the competent authorities shall supervise and urge employers to make the members and standard of enjoying allowance (subsidy) public in the enterprises at the end of each year. In case of cheating allowance(subsidy) by practising fraud, or in case of untimely report on terminating allowance (subsidy) and continuing to get allowance (subsidy) etc., it shall be for the employers to take back the released allowance (subsidy) within 3 months; in case it can not be taken back in the set time, it shall be for the employers to make advance expenditure and for serious cases, no application shall be handled for allowance (subsidy) from the said enterprises within two years.  

3.In case of any cheating loan behavior by practising fraud from any individual or enterprise, the district CPC talent office, and the district human resource and social assurance bureau will take the following measures to have serious treatment: to cancel his/its application qualification of various allowances (subsidies) in future; to circulate his/its behavior to the people’s bank and the city joint credit system management department and record the corresponding credit system of the applicant’s behavior; to expose the relevant violation information of the applicant in relevant media.

4.All towns, sub-districts (platforms) and the competent authorities shall enhance dynamic management on those members who enjoy allowance (subsidy), understand the situation of their enterprises on a regular basis, keep well the follow-up work and set up sound allowance (subsidy) release information files. The district human resource and social assurance bureau will have regular inspection on allowance (subsidy) release work within the scope of this district.

5.For those same type of in-service talents who have worked in enterprises before the issue of this method, the said enterprises may upgrade their salary and treatment appropriately according to the enterprise’s actual situation and their work capability and performances, so as to create nice environment that is beneficial for introducing talents and keeping talents.

 

VII. Supplementary rules

This method shall be implemented from May 1st, 2018 and meanwhile Xiaoshan District Implementation Method of Living Allowance and Subsidy for Enterprises to Introduce and Train Senior Talents (Trial) and Xiaoshan District Implementation Method of Talent Settlement Project (Trial) shall be abolished.
